The four officers of the Gujarat Police received an High Court Notice mistreating and publicly displaying the accused individual who was doing high speed stunts in an Mercedes-Benz SUV.

Incident: What happened?

The Gujarat High Court issued a contempt notice to four police officers from the DCP Zone-7 team, accusing them of physically mistreating and publicly displaying an accused individual. The said individual had allegedly been engaging in reckless driving stunts on public roads using his Mercedes-Benz SUV. The incident took place in July 5th, when 24-year-old Junaid Mirza found himself paraded on Sindhu Bhavan Road by police officials. During this procession, Mirza held a placard bearing a message that read, “Gaadi mere baap ki hai, par road nahi,” which translates to “The car belongs to my father, but not the road.”

Mirza filed a complaint with the High Court, alleging that DCP Bhagirathsinh Jadeja, Sarkhej Police Inspector V. J. Chavda, PSI DP Solanki, Satellite PSI Dineshsinh Rathod, and Constable Irfan Sheikh had subjected him to public humiliation by disregarding the directions issued by the Supreme Court. In response, Mirza, represented by his attorney Siddharth Kheshkani, has requested the court to take appropriate action against these police officers. A division bench has requested responses from the police officers mentioned in Mirza’s application, except for the DCP, regarding why action under the Contempt of Court Act should not be pursued against them.

The incident took place in 2021, and the video is also dated from that same year. It unfolded on SB Road, where Junaid Mirza and his associates were reportedly engaged in performing stunts using a Mercedes-Benz car. In February of this year, a video capturing these reckless driving antics gained significant online attention, showcasing a group of young individuals participating in hazardous driving maneuvers on public roads.

The initiation of the FIR was based on the video evidence recorded in 2021. Notably, when the charge sheet was formally submitted, Junaid Mirza was listed as a witness rather than a primary suspect. However, according to Mirza’s legal representative, the police subjected him to victimization as a consequence of his and his father’s refusal to pay a Rs 10 lakh bribe to the DCP’s office in exchange for a firearm license. Allegedly, when this bribe was declined, a case was fabricated against Mirza.

In response to this incident of apparent public humiliation carried out by the Gujarat Police on Sindhu Bhavan Road (SBR), the Gujarat State Human Rights Commission (SHRC) commenced legal proceedings. The SHRC has directed the Director General of Police (DGP) to conduct a comprehensive inquiry into the matter, entrusting an officer of the rank of Inspector General of Police or Additional Police Commissioner with the task of submitting a report within 20 days. Additionally, the SHRC has stated its intent to take suitable action in accordance with Section 18 of the Human Rights Act of 1993, following the necessary verification procedures outlined in Section 12 of the Act, as conveyed by Mirza’s legal counsel, Kheskani.
